Website, parking, portal and service provision terms for Metropark Ltd trading as PARKULTRA®.

1. Who we are

These Terms & Conditions are issued by Metropark Ltd trading as PARKULTRA® (“PARKULTRA®”, “Metropark”, “we”, “us” or “our”). PARKULTRA® provides parking-management services, permit administration, visitor parking tools, PCN payment and appeals portals, nuisance parking reporting tools, self-ticketing evidence-submission tools and related customer services.

2. What these terms cover

These terms are intended to cover use of this website, use of online portals operated by us, parking at sites managed by us, and the general public terms under which PARKULTRA® provides parking-management services.

Separate customer contracts, Parking Management Service Agreements, Letters of Authority, commercial schedules, patrol schedules, enforcement hours, customer-specific site rules, service fees and operational documents are private and confidential. They are not intended for publication on the public website and should only be made available to the relevant customer or authorised user through the Customer Portal or other agreed secure process.

3. Site parking terms and signage

Parking terms at individual sites are set out on site signage and, where relevant, through online information such as QR-code landing pages, permit rules, visitor parking instructions or customer portal schedules. By entering, parking, remaining parked or otherwise using a managed parking area, the driver is expected to comply with the displayed site parking terms.

The essential parking terms will normally be displayed at the relevant site. QR codes and online pages may provide additional information, expanded terms, privacy information, permit instructions, visitor parking instructions, payment information or appeal information, but they do not remove the need to comply with the terms displayed on site.

Common site terms may include requirements to park only in authorised areas, display or hold a valid permit where required, avoid obstruction, comply with time restrictions, follow visitor parking rules, and comply with ANPR, CCTV, patrol or body-worn camera notices where those systems are used.

4. Website and portal use

You must use this website and any PARKULTRA® portal lawfully, accurately and responsibly. You must not submit false information, upload unlawful or misleading material, attempt to access areas for which you are not authorised, interfere with the operation of the site, or misuse payment, permit, visitor, nuisance parking, appeal or evidence-submission systems.

5. Permits and visitor parking

Permits, visitor parking sessions and authorisations are subject to the rules of the relevant site. A permit or visitor session does not override signage, bay restrictions, maximum stay periods, no-return periods, scan-in/scan-out requirements or any other site-specific condition unless expressly stated.

Where a permit or visitor parking record is issued electronically or through a portal, the live permit or visitor record may be used as part of the evidence of parking entitlement. A physical or printed permit may still need to be displayed where the site rules require it.

6. PCNs, payments and appeals

Where a vehicle is parked in breach of the applicable site parking terms, a Parking Charge Notice may be issued or processed in accordance with the relevant signage, evidence, industry requirements and applicable law. Where a Parking Charge Notice is issued, Metropark Ltd trading as PARKULTRA® may act as principal and creditor in relation to that Parking Charge Notice.

Motorists may use the PARKULTRA® portal to locate a PCN, make payment or submit an appeal where the relevant online service is available. Payment amounts are calculated from the PCN record and the applicable parking terms. Where an appeal is submitted, supporting evidence should be truthful, accurate and unaltered.

Payment through the portal does not prevent PARKULTRA® from correcting an obvious administrative or technical error where permitted by law. Appeals are reviewed through the applicable process and, where available, motorists may be directed to an independent appeals route.

7. Evidence, camera systems and uploaded material

Parking sites managed by Metropark Ltd trading as PARKULTRA® may be monitored by ANPR, CCTV, patrol officers, body-worn cameras, permit systems, visitor parking systems, customer evidence submissions or other parking-control technology.

Users of our portals may submit photographs, documents or other evidence in connection with permit applications, appeals, visitor parking sessions, nuisance parking reports, self-ticketing submissions or parking enquiries. By submitting evidence through a PARKULTRA® portal, you confirm that the information and material provided is true, accurate and unaltered to the best of your knowledge.

Submitting evidence does not guarantee that any Parking Charge Notice will be issued, cancelled or upheld. Metropark Ltd trading as PARKULTRA® will review the evidence and will retain discretion over enforcement action, appeal decisions, cancellations, further enquiries and recovery action.

8. Nuisance parking reports and self-ticketing evidence submissions

The Report Nuisance Parking portal allows authorised customers, residents and site teams to report repeated misuse, obstruction, visitor-bay abuse or other parking issues for PARKULTRA® review. A nuisance parking report is not a PCN and does not automatically result in enforcement action.

The Self-Ticketers portal allows authorised users to submit evidence of potential parking breaches for PARKULTRA® review. Self-ticketing users do not issue PCNs themselves. PARKULTRA® reviews the evidence and decides whether any PCN should be issued or progressed.

Authorised self-ticketing users may be required to complete PARKULTRA® training and assessment before access is granted. Evidence submissions must be accurate, complete, unaltered and made only in relation to sites or areas for which the user has permission to submit evidence.

PARKULTRA® may reject a self-ticketing submission where evidence is unclear, incomplete, inconsistent, outside the authorised area, duplicated, submitted by an unauthorised user, or otherwise unsuitable for enforcement.

9. Customer service provision terms

PARKULTRA® may provide services to landowners, managing agents, residents’ management companies, commercial operators and other customers. Service provision terms may include site assessment, signage, permit administration, visitor parking, nuisance parking reports, enforcement support, PCN processing, appeals handling, payment processing, reporting, customer support, account access, self-ticketing review, training modules and related services.

Customer-specific terms, schedules, site rules, pricing, service levels, DPIAs, data-sharing summaries and operational requirements may be listed within a customer portal or agreed separately in writing. Where there is a conflict between these general terms and a signed customer agreement, the signed agreement will normally take priority for that customer relationship.

10. Payments

Payments may be processed by third-party payment providers. We do not ask you to send full card details to us by email. Payment confirmation records, transaction references and status information may be stored for audit, reconciliation, appeal, customer-service and reporting purposes.

11. Availability and changes

We aim to keep the website and portals available, but we do not guarantee uninterrupted availability. We may update the website, service wording, forms, payment flows, operational processes and these terms from time to time.

12. Intellectual property and branding

The PARKULTRA® name, branding, website content, portal designs, signage designs, system wording and other materials belong to Metropark Ltd or its licensors unless stated otherwise. You must not copy, reuse or adapt them without permission except where allowed by law.

13. Liability

Nothing in these terms limits liability where it would be unlawful to do so. Subject to that, PARKULTRA® is not responsible for losses caused by misuse of the website, inaccurate information supplied by users, third-party system outages, or failure to follow site parking terms.

Users of parking sites remain responsible for securing their vehicles and possessions. Unless liability cannot lawfully be excluded, PARKULTRA® is not responsible for theft, damage, vandalism or loss occurring at a parking site merely because the site is managed or monitored by us.

14. Governing law

These terms are intended to be governed by the laws of England and Wales. Any disputes will be handled through the relevant complaint, appeal, contractual or court process depending on the nature of the matter.

15. Fees, VAT and third-party charges

Unless expressly stated otherwise in a signed site-specific schedule, PARKULTRA® prices and charges are exclusive of VAT. VAT, payment processing fees, postage/fulfilment charges, IPC or regulatory fees and third-party costs may apply depending on the service, site and selected module.
